Money-starved Palike comes out with TDR

Faced with acute financial crunch, the Bruhat Bangalore Mahanagara Palike has come out with Transferable Development Rights (TDR) to compensate people who lose their properties to widening of 207 roads in the City.

According to a BBMP official, TDR is an instrument through which the Palike facilitates landlosers to construct additional floor or building in the remaining portion of the property or anywhere in the City. While the proposal apparently lacks the element to attract landlosers, the Palike intends to make it popular. According to BBMP authorities, TDR has been successfully implemented in Mumbai and is now set to be replicated in Bangalore.

The BBMP would issue a Development Rights Certificate (DRC), which can be either be utilised for personal need or can be sold to anyone who wants to construct an extra floor. The owner gets the right to construct a built up area 1.5 times over and above of that the property acquired for development. For instance, if 600 sq ft built-up area is given up to the BBMP, the property owner will receive a DRC for 900 sq ft built-up area.

The Certificate will also enable the person to use the certificate for another building he is constructing or has constructed already.  The  TDR was notified by the State Government in February 2005. The BBMP decided to popularise the TDR so that the people voluntarily part with their property for development. But the voluntary part has met with much scepticism, since it is widely perceived as a lopsided, which would leave landowners little option to defend their property.

The idea to issue TDR certificates was brought up by the BBMP to avoid paying compensation in the form of money or a free site to the landlosers. “People should know that we are not in a position to compensate the loss suffered by the landlosers. Property tax and income from advertisement charges are the only sources of revenue to the Palike,”said Chikkamuniyappa, Deputy Commissioner, BBMP. The Palike is left with no other option but to float the TDR scheme. He added that the state of affairs is no different in all the municipal bodies across the country.

Viable option

The fund crunch is so severe that local bodies have been finding it difficult to pay salaries to its employees. Ultimately, the State Finance Commission has reserved funds for salaries. Under this circumstance, the TDR scheme is the only viable option, he explained.

The moot question, however, is the ‘tradeability’ of TDR certificate even as the government has been attempting to introduce Sakrama scheme to regularise the structures constructed in violation of building plan, and corrupt officials turning blind eye to violations.

The BBMP may not find it tough to demolish houses on revenue land even if they possess the Palike Khata. But it would be a challenging task for it to evacuate people owning BDA property. Most of the BDA property owners are up in arms against the BDA for lacking vision.

Chandrashekhar, a resident of VVPuram, with property in Kumaraswamy Layout contends that if the BBMP wants to acquire private land in BDA layout, it will have to pay compensation for the loss. “Seize the properties of the BDA officials who formed the KS Layout so shabbily, auction it and pay compensation to people who would lose land. Why should we be at the receiving end for the fault committed by the BDA?” he wanted to know.

Legal angle

 Dispelling public perception that the TDR cannot be challenged in the court, legal experts assert that it can indeed be questioned.  B V Acharya, former Advocate General said that any action related to road widening and developmental work can be challenged. “Only the scope for it is limited as the courts will go by the larger public interest,” he said.

Citing several Public Interest Litigations against National Highway projects and the Metro Rail, he said even the mega projects have rights for objections, although the grounds are limited.

‘Alternative sites under consideration’

The government is contemplating to purchase the Transfer of Development Rights from the property losers and give them alternative sites, said Mayor S K Nataraj.

Speaking to Deccan Herald, the Mayor said, the idea, in its infancy is under serious consideration. He hinted that the owners of the legitimate buildings would be benefited but not those who are having houses on revenue land. He defined legitimate buildings as houses or apartments constructed on BDA, BBMP, BMRDA or Karnataka Housing Board approved sites.

The Mayor said the BBMP is in the process of identifying places where the landlosers would be given alternative sites. “We are in talks with the Karnataka Housing Board, BDA, BMRDA and would also see how much land BBMP has with it to spare for such purposes,” said the Mayor.

I think "Road Widening " is a good move. I agree other alternatives like Public transport and peripheral corridors should have been tried first. Anyways my sympathies are with current land/property owners. It was a farm land before and farmers had lost their land (dry , waste or wet). The wheel has come a full circle apparently. Back to serious topic I think TDR may or may not to be a just compensation. I think BBMP can acquire twice the no. of the property and make the land loosers joint owners of the surplus land (with higher TDR) acquired. Ex: Suppose a 100ft road is bordered by back to back) 30X40 sites on both sides , one 30X40 site facing 100 ft road and another which faces a smaller road parallel to 100ft road on each side. BBMP s aim is to widen 100 ft road to 150 ft wide - that is extension of 25 feet on both sides. Leaving only 30X15 site for the property owner(originally 30X40). BBMP can instead acquire both the back to back properties and make the two back to back neighbours joint owners of 30X55 plot with douple or triple the TDR so each owner now has 30*22.5 site. So instead of 1000 sites for the 14+km stretch acquire 2000 sites. Return back 1000 properties collectively with higher TDR. Just imagining.. I know this is a political graveyard and we need true leaders who can take all of us through. I will send this email to SE(BBMP) let us see what happens.

BBMP WITHOUT ANY CASH IN THEIR POCKETS THEY WANT TO MAKE BANGALORE A SINGAPORE CITY , MR BBMP FIRSTLY KINDLY SUPPLY CLEAN DRINKING WATER, 24HRS ELECTRICITY , NEAT ROADS, AND BACIC NEEDS OF THE PEOPLE , AND THEN HAVE MONEY IN YOURS POCKETS TO BY PRIVATE PROPERTIES WITHOUT A PENNY YOU WANT THE INNOCENT PEOPLE TO GIVE AWAY THEIR HARD EARNED PROPERTIES FOR UNWANTED ROAD WIDDENING, IF REALLY YOU (BBMP)HAVE ANY SENSE IN THE RIGHT PLACE YOU MAY THINK OF FRAMING A NEW BANGALORE ON THE OUTSKARTS. ROAD EXPANSION PLAN BY BBMP IN BANGALORE It is very much In recent news that BBMP has determined to take action for Road widening to total 216 roads in Bangalore in order to manage the traffic flow and going to acquire the private properties by offering only the TDR. Since there is no much response from the public to give away their hard earned properties just for the TDR, now the BBMP officials are planning to meet the people to convince them to hand over their property just for the TDR letter only as the compensation. BBMP also very well aware that as long as there is a plan to collect the fund under the ukrama sakrama scheme who will care to make use the TDR letter for rising the building height. Hence the public who can go for handing over their properties just for the TDR will no way be benefitted in any manner. Therefore the government is not fair in asking the property owners to surrender their properties without giving any monitory benefit. Also roads widening is not a very good idea for managing the traffic flow to the rate at which the city is growing. Few roads which BBMP have recently widened have already become congested and may lead to think for further widening of all such roads to meet the present growth demand. If this idea continuous periodically, when the public will utilize their properties for their peaceful living. It is brought to the readers notice that out of 216 roads now planned for expansion by BBMP, the Banaswadi main road is one such where the BBMP have already marked all over the road on either side for widening to 80 feet width up to the ring road with out caring the property owners agony for demolishing their existing buildings where BBMP also is collecting the property taxes and planning to grab the properties under the name of TDR with out offering any monitory benefit or alternate land for the owners survival. This Banaswadi main road was once widened from 30 feet to 60 feet width all along from the then railway gate up to Banaswadi village by BBMP/BDA with out giving any type of benefit to the property owners in the name of city improvement and included the Banaswadi village under BBMP and collected betterment charges & imposed heavy property taxes. However the same property owners are now have to forego further loosing their properties to meet 80 feet width requirement by showing TDR as a caret in their front. Is it justified? The present flyover recently constructed at Maruthi sevanagar by BBMP over the railway line in view to smoothen the traffic flow is also only within that 60 feet wide road which is already become congested and very much affect the traffic flow. This FLYOVER also may be in the BBMP plan for widening up to 80 feet width to match with the road width. If such an example is very much there in our front, at what period the road expansion plan will come to an end to meet the city growth?. The 80 feet wide now marked for expansion may be further to be widened to 100/150 feet after few years. Even BDA/BBMP are only very recently checking their land records due to the unexpected fast growth of Bangalore city and forcibly taking over the government properties from the users which they were using from long years with out bothering about their sufferings or losses by demolishing their buildings and immediately announces the value of the land taken over by them working out the present market value for such lands showing in corers of rupees as their achievements. Therefore BDA/BBMP should follow the same rule when they want to make use the private properties for the government usage by offering the present market value/ alternate land for the taken over land for the owners survival and not just the TDR certificate to grab the property. In the case of Banaswadi road widening process if it is a must, then it is suggested that the road expansion of 80 feet width can go up to the fire station center and further link with the existing 100feet road that leads to the ring road instead of further going by demolishing all the buildings of Banaswadi village to widen the Banaswadi main road to link with the ring road. If this process is considered, there will be very much saving in the budget as well less suffering for the property owners. Will the BBMP look into this suggestion and alter their road widening plan for the benefit of the government as well the property owners. Still the BBMP like to widen the roads with out considering the public opinion, there is no other alternate than going for legal method to get justice for the property owners. Thanking you By G. Where the hell will the property loosers will have money to build addiotional floors will BBMP finance this projects. In many cases where the markings are there a man haveing 30 X 40 feet site if he looses 10, 15 20 feet what the hell he will construct, will BBMP officials construct their houses in such awkard sites. Also 1 to 2 lakhs it is to construct one square now after BBMP demolishes where will they have money to repair and construct extra floors. Really BBMP this kind of mad policiees nowehere it is done. Also do you know if you undertake this p[rojects in 216 roads lakhs of trees you will mercilessly cut it down how much eco diasster you will cause have you calculated it and all this nonsense to cater to your automobile mafias. What the hell the common man will get from this the tree shade he will loose, traders will be affected property owners will be devasted

In palace road many top VIP buildings like hotels etc. is not touched in this devilih demolition but the POOR GOLF club rich in greenery is targeted, so also if there is flats and other big buildings owned by big shots it is not touched. Why this discrimination and cheating

To all the citizens of bangalore who are losing their houses for this stupid road widening i have one thing to say in loud " DO NOT ACCEPT TDR IT IS NOTHING BUT ONLY A PIECE OF PAPER AND OF NO USE TO THE LOST LAND OWNERS " "GOVT IS CHEATING LAND OWNERS BY SAYING TDR WILL BENEFIT AS COMPENSATION BUT IN REAL SCENARIO IT IS NOT ". DO NOT ACCEPT TDR. ROAD WIDENING IS ILLEGAL.
