Contempt: HC imposes cost of Rs 25,000
Land allotted to ex-serviceman in Hegdenagar encroached
The High Court of Karnataka on Monday imposed a cost of Rs 25,000 each on four persons for disobeying a lower court order.
Fatima Bi had filed a petition against Razak, Zafarullah, Mehboob and Shahtaj alleging that they had illegally constructed a structure over her land at Hegdenagar in the City. It was alleged that the land allotted to ex-serviceman Syed Abdul Latif, father of the petitioner, was encroached by Razak, who not only constructed the house, but also leased it out to the other three.
Two lower court orders, one in 2004 and another in October 2009, could not evict them. They filed an appeal in the High Court against the order directing them to vacate the premises within 30 days. However, the High Court upheld the lower court order and the petitioners gave an undertaking to vacate the place by April 18, 2010.
Fathima Bi filed a contempt petition since the four failed to comply with the undertaking. A Division Bench comprising Chief Justice J S Khehar and Justice Manjula Chellur directed the respondents to vacate the place and handover the possession to the petitioner by Monday afternoon.
The Bench also imposed a cost of Rs 25,000 each on all the four respondents as a litigation expenditure to the petitioner.
NBW recalled
The High Court has recalled the non-bailable warrant issued against Bharathi Urs after she surrendered and directed her to furnish a bond of Rs one lakh along with a surety for equal sum. A Division Bench comprising Justices K Sreedhar Rao and B V Pinto has directed Urs to comply with the order within ten days at the trial court.
Notice to govt
The High Court has ordered notice to the State Government over allocation of shops at Yeshwantpur APMC yard.
Shivayogi Traders and 17 others had challenged the allotment of shops and godown at the yard to 49 individuals. Counsel for the petitioners, Sathenahalli, submitted that according to rules traders carrying on business for the past three years by paying market fee were entitled for allotment of shops.
However, the shops have been allotted to five persons who supported the president in the last elections.
Pointing out that the allocation violates the APMC Allotment Rules 1984, the petitioners have sought to quash the allotments and appoint a committee to probe the matter. Justice Abdul Nazeer ordered notice to the State Government and others.
