'Evidence by bank officials play major role in court verdict'

“Evidence by the bank officials play a major role in the court verdict,” said District Sessions Judge, Udupi K N Phaneendra.

He was speaking after inaugurating a legal awareness programme organised by Syndicate Bank Regional Office, Udupi district, in association with Udupi district Legal Services Authority and Bar Association here on Tuesday.
“It is essential to create an awareness on various laws on the banking sector among the officials.”

There are enormous laws which provides security for the bank officials, he said and added: “In case of any legal problem, then it is essential that the facts surrounding one’s act should be proved in the court for the exemption. However, if there is bonafides, then you are not liable.”

He also said all Indian laws are well defined and courts have given more decretory powers based on equity, justice and good conscience and added “Negotiable Instruments Act” is more prominent in the banking sector. 
Deputy Public Prosecutor Devraj Shettigar suggested the maintenance of common registrar which will be useful for all the mortgages and cautioned that title deed of the previous property holder should be strictly examined by the bankers before sanctioning the loan on the property.

Expressing dissatisfaction over the failures of advocates to protect the bankers, Mr Shettigar said many times bankers are asked for legal opinion within 24 hours which is truly injustice as many hidden things need sufficient time to get revealed, he added.

Additional Civil Judge Senior Division Udupi A M Ramachandrayya, Bar Association President M Ratnakar Hegde, RBI (Bangalore) Manager  Venugopal, EO Taluk Panchayat Ramanand Nayak, DGM Syndicate Bank Sujir Prabhakar were present on the occasion.
