Notices issued to Centre, State, CS

The Central Administrative Tribunal (CAT) on Friday, ordered notices to Central and State governments, and the new Chief Secretary Sudhakar Rao on an application by his predecessor P B Mahishi.


Mahishi’s application has sought CAT to quash the February 6, 2008 State government notification transferring him to the post of chairman of Karnataka Power Corporation Limited (KPCL), while appointing Sudhakar Rao as the CS. Mahishi has also sought a direction to the State government to restore him to his original position of CS.
Mahishi in his application, has contended that he was displaced by arbitrary exercise of power for a collateral purpose of favouring the new incumbent of the post, Sudhakar Rao. It also said that the position to which he is posted now is one lower in status to the post of Chief Secretary.

The CAT Bench headed by Justice Shantappa ordered notices, and posted the hearing to March 6, 2008 while granting time to respondents to file their reply statements.

Another application by Additional Chief Secretary and BDA Chairman Dilip Rau, challenging Sudhakar Rao’s appointment on the ground that his seniority was overruled is also posted for hearing on the same day.
