Co-op society to pay up Rs 22 lakh

The Karnataka State Consumer Disputes Redressal Commission, has found Vishwabharathi House Building Co-operative Society guilty of deficient service and has ordered it to pay up Rs 22,00000 to a consumer.


K Subramanya of Bangalore had paid up Rs 40,000 to the Society in Girinagar for a 40 x 60 ft site and had got a site with a sale deed and possession certificate in 2003. But later he found out that the site allotted to him did not belong to Vishwabharati and was on land acquired by the BDA.

He complained to the State Commission and the President Mr Justice Chandrashekaraiah ruled that by executing the sale deed in favour of certain persons, and forming a layout on land not belonging to it, amounted to cheating the general public. Considering that since the site value in and around Bangalore has reached sky high, the Vishwabharathi Society would have to pay up Rs 22,00000, along with interest at 12 per cent per annum from the date of his complaint till realisation along with costs of Rs 2000.

BDA to compensate

N Dhanalakshimi had bought  a site  near Kengeri Hobli, Bangalore south taluk.  She also had a registered sale deed dated 15-12-1995. But the BDA acquired her land and assured her that after developing them, they would give her a developed 30 by 40 site. On 13-12-2002  she submitted an application to the BDA for allotment of the alternate site. But later the BDA asked her to contact the Revenue Inspector, Assistant Engineer and other officers at Doddabasti village bus stand on 15-2-2006 and to produce original sale deed, and the lay out plan.

Despite doing so, the BDA did not allot the site. She then complained to the IV Additional District Consumers Dispute Redressal Forum which ordered the BDA to allot an alternative site to her within sixty days of receiving its order and to also pay her Rs 10,000 as compensation along with Rs 5000 as costs.

ESI case

K Saraswathi who works  in a firm has been provided with medical facilities from the ESI, Rajajinagar. She availed of the medical facilities three times and spent a total of Rs 4,448 which the ESI is supposed to reimburse. She submitted all the necessary bills but in vain. She complained to this Forum which ordered the Director, ESI, Rajajinagar, to reimburse Rs 3,547 to her within six weeks along with 9 per cent interest and Rs 1000 as costs.
