The interim order of stay was passed by the Bench headed by Justice K Sreedhar Rao, following a writ petition by the three officials H V Girish, (now) sheristedar in BDA’s SLAO section, Kalleshappa, (now) an FDA in DC Office, Bangalore and B R Krishnan, (now) SLAO, BDA.
The single judge order was passed in the course of a writ petition filed by wife and children of late T Krishna Reddy, owner of certain land at Jaraganahalli of Bangalore South taluk.
The judge had observed that an order permitting the land’s conversion for non-agricultural purpose had been passed during 1999 by the then Spl.DC, subsequent to their acquisition for the purpose of GSI Employees’ Association.
In the case, Bangalore Urban DC had filed an affidavit explaining that Spl DC’s conversion order was based on the recommendations and reports of his subordinate officers - the three petitioners who were at that time working as revenue inspector, tahsildar and office assistant to the DC, respectively, and one K S Shivashankar who was HQA to the DC and two retired officials.
Following this, the judge on July 25, 2007, had directed Bangalore DC to initiate appropriate action against the four officials still in service, and to file report by July 31.
