Lokayukta probes BBMP engineers over illegal structure

In a strong message to BBMP engineers, the Lokayukta has ordered an investigation with regard to an illegal construction of a commercial complex at Nisarga Layout in Gidadakonenahalli, near Kengeri.

During an enquiry, based on an anonymous complaint by the residents of the layout, it was submitted to the Lokayukta that the BBMP engineers have taken steps to raze the building.

However, Lokayukta Justice P Vishwanath Shetty has ordered an investigation to fix responsibility on the engineers, who ignored the violations while the building was being constructed.

The anonymous complaint stated that one Anand was violating the building regulations while constructing the complex at site No135/A in Nisarga Layout.

Subsequently, the Lokayukta directed the Lokayukta police to conduct an enquiry. The police in their report said the building regulations were indeed violated and that the authorities have considered the construction as illegal and took steps accordingly.

The BBMP officials have taken steps to raze the building and were waiting for the funds for the same, it said and recommended the closure of the petition.

Subsequently, the Lokayukta sought a note from the assistant registrar (Legal Opinion) on the police report.

The legal opinion report held that the structure was built not only in violation of the building norms but had also encroached upon the footpath.

The legal opinion cell opined that the BBMP came forward to raze the building only after the complaint was filed before the Lokayukta.

"It would be in the interest of justice to examine who are the officials who have failed in their duty in not preventing the unauthorised construction on the site, and also the steps taken to remove the illegal structure," Justice Shetty stated in the order.

The notice has been issued to BBMP Commissioner Manjunath Prasad, Executive Engineer (ward 72) Shashikumar and two assistant engineers of the ward to submit their reply in eight weeks.
