Order on quota in SC/ST promotions implemented, Supreme Court told

The state government has told the Supreme Court that all its departments, boards, corporations and statutory bodies have complied with the court's February 9, 2017 direction for consequential actions, including reversal of promotions, with invalidation of the law on reservation in promotion for Scheduled Castes and Scheduled Tribes employees.

In an affidavit to the top court, chief secretary K Ratna Prabha submitted that her assertion was based on letters and certificates received from additional chief secretaries, principal secretaries and secretaries of the departments of Karnataka, stating that the orders of the apex court in 'the B K Pavitra case' had been complied with in their departments and undertakings.

She has sought a direction to dispense with her personal presence in the court on Wednesday, April 25.

The apex court had, on February 9, directed for the government to revise the seniority list in three months and to take consequential action thereafter within the next three months. The consequential actions included promotions and reversions.

Subsequently, the time given to implement the directions was extended by the top court on two occasions, up to March 15. The government's request to further extend the time for six months for the purpose was rejected by the court on March 20. The court had then said, if the judgement was not complied within one month, the chief secretary may remain present on April 25.

A bench of Justices Adarsh Kumar Goel and U U Lalit, which had passed the February 9 judgement, is likely to take up a batch of contempt petitions on Wednesday. The petitioners' counsel Kumar Parimal, for his part, said that they would raise the issue that certain departments like PWD were yet to act on the directions of the court.
