The Supreme Court on Monday agreed to consider a plea asking for a stay on the release of Anil Kapoor-starrer film Fanney Khan.
The film is scheduled for a release on August 3.
A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud posted the petition for hearing on August 1 on a request made by advocate Ravi Prakash Mehrotra.
The petitioner, Pooja Entertainment of Vashu Bhagnani, claimed its reputation, fair name and profitability has been “adversely and unfairly affected, in a most unjustified and unseemly manner, owing to certain machinations and surreptitious arrangements between, a co-producer, Kriarj Entertainment Private Limited, Mumbai and Super Cassettes Industries Private Limited New Delhi, in relation to all India distribution rights of the film Fanney Khan”.
It said though the sole distribution rights for the film were sold to it for a sum of Rs. 10 crores, a sum of Rs 8.50 crores has been paid and duly acknowledged.
However, in connivance with others, the rights were parted with its entire co-production and distribution rights, it claimed.
In the case, two suits were filed by Delhi and Bombay High Courts.
The petitioner sought direction for transfer of the suit pending in the Bombay High Court to the Delhi High Court or to the Supreme Court and stay the release of the film in the interregnum.
