The Madras High Court has dismissed a petition which sought to quash proceedings in a lower court against Tamil actor Dhanush's father Kasturi Raja in a cheque bounce case.
Justice R Subbiah said the plea raised by the petitioner that the power of attorney of the complainant cannot conduct the case was not a ground to quash the complaint.
Raja had obtained a loan of Rs 65 lakh from S Mukanchand Bothra and had not repaid the amount. After repeated reminders he issued a cheque for Rs 25 lakh as part payment, which was dishonoured due to insufficient funds.
Bothra issued a legal notice but Raja failed to pay the amount and a complaint was filed in the Metropolitan Magistrate Court here under the Negotiable Instruments Act against him.
The compliant was filed through M Gagan Bothra, who was the power agent of Bothra and it was challenged by Raja that the case cannot be conducted by a power of attorney.
Dismissing Raja's petition, the judge cited an earlier judgement by a Division Bench, and said it showed that there was no law prohibiting filing of the complaint through power of attorney.
