Case stayed against Ramky boss in manhole death case

The high court on Thursday stayed the proceedings against Alla Ayodhya Ramireddy, chairman, Ramky Infrastructure, who was booked for the death of three manual scavengers in Kaggadasapura on March 8.

A private complaint was registered with the Baiyappanahalli police blaming the company for the death of the workers who had gone into the drain to clean it. Following the complaint, the police filed an FIR against Ramireddy and Alla Peri Reddy.

The Reddys approached the court seeking quashing of the FIR on the grounds that the workers were not engaged by them. BWSSB, the government agency which had awarded the work to Ramky, had even released their bank guarantees and certified them for completion of work at the location. The petitioners said they had completed the underground work and had no idea why the workers had entered the drain.

They argued they cannot be held under vicarious liability (refers to a situation where someone is held responsible for the actions or omissions of another person). Justice Anand Byrareddy granted stay on the proceedings and ordered notice to the Baiyyappanahalli police.
