Bengaluru: The Karnataka High Court has issued a notice to the state government regarding a petition seeking 33% reservation for women in the elections of the Advocates' Association of Bengaluru (AAB).
Vacation judge Justice Suraj Govindaraj also directed notices to the Karnataka State Bar Council and the AAB, adjourning the matter to Monday.
The petition, filed by Bengaluru-based advocate Deeksha N Amruthesh, relies on precedents set by the Apex Court in the Supreme Court Bar Association Vs BD Kaushik case and the Delhi High Court's Fozia Rahman Vs Bar Council of Delhi and Another case.
The petitioner argued that the lack of implementation of the Supreme Court's directives regarding a mandatory reservation of at least one-third of executive committee seats for women violates fundamental rights guaranteed under Article 14, Article 15, and Article 19(1)(g).
"The respondents' inaction in implementing the Supreme Court's directives and addressing the issue of gender disparity necessitates judicial intervention. The upcoming elections in February 2025 present a critical juncture to enforce the Supreme Court's mandate and ensure equitable representation of women in the AAB's governing body. Immediate action is essential to uphold the principles of equality, diversity, and inclusivity in the legal profession," the petition said.
