SC issues notices to BSY, Bopaiah

A bench comprising Justices Altamas Kabir and Cyriac Joseph issued the notices after hearing the counsel for the petitioners whose disqualification has been upheld by Karnataka High Court.

The Apex court has asked the Chief Minister and the Speaker to file their responses by December 7 and the next hearing has been fixed on December 9.   The 11 BJP MLAs were disqualified by the Speaker for revolting against the Yeddyurappa government.

Petitioners Balchandra L Jarkiholi, Gopal Krishna Belur, M V Nagarj and others were also debarred from voting during the vote of confidence as they openly declared that they would vote against the BJP led Government.

The petitioners contended that the speaker did not give them an opportunity to explain their position before disqualifying them.

The Speaker, however, disqualified them under the provisions of anti-defection law taking their statements into account.
