The Orissa High Court on Thursday ruled that a court can grant a woman maintenance exceeding the amount that she had claimed, after considering facts of the case.
As reported by Live Law, the maintenance amount can exceed the amount she had claimed in her application under Hindu Marriage Act, 1955.
The division Bench observed, "The judicial discretion must be exercised to provide a fair and just maintenance amount, considering the dependent's actual needs and the payer's financial capability, even if the claim was initially understated," as reported by the publication.
