A bench of justices Tarun Chatterji and Aftab Alam said it has left the amount of compensation to the state government.
However, the bench said it might consider transferring the probe into the fake encounter case to a Special Investigation Team which is inquiring into the post-Godhra communal riots f there was any laxity in probe.
The court said it would take a final decision on these issues next week.
