HC adjourns BTC horse trainer’s petition

The Karnataka High Court adjourned a petition for the final hearing of the case of doping controversy surrounding a racehorse of Bangalore Turf Club (BTC).

Justice Michael D Cunha was hearing a petition filed by Neil Darashah, a horse trainer at the BTC.

He had sought the quashing of the FIR and charge sheet filed by the Criminal Investigation Department (CID)before the first Additional Chief Metropolitan Magistrate (ACMM) Court for the alleged commission of offences
concerning the doping of ‘Queen Latifa’, a three-year-old racehorse.

The petitioner has also sought for quashing of proceedings pending before the ACMM court.

As an interim prayer, the petitioner had also sought for a stay on the proceedings on the ground that it is a clear abuse of due process of law.

H S Chandregowda, son of H Sanjeevaiah, member of the management committee of the Karnataka Race Horse Owner’s Association had lodged a complaint with the police against the petitioner and six others on the grounds of an alleged report from the National Dope Testing Laboratory, New Delhi that confirmed the doping of the Queen Latifa.

Following this, an FIR was registered against the petitioner and six others. Thereafter, the CID filed a charge sheet alleging commission of offences punishable under sections including 420 (cheating), 418(intentional cheating with knowledge), 202 (Intentional omission to give information of offence by person bound to inform), 120 (Concealing design to commit offence punishable with imprisonment) of the Indian Penal Code and section 11 (c) (willfully and unreasonably administers any injurious drug or injurious substance to any animal or willfully and unreasonably causes or attempts to cause any such drug or substance to be taken by any animal).

The court has adjourned the case for final hearing to July 20.
