Rs 1 lakh cost on petitioner for abusing law

The high court imposed a cost of Rs 1 lakh on a petitioner for abusing the process of the court and that of PIL’s jurisdiction.

A division bench headed by Chief Justice Dinesh Maheshwari imposed the cost after dismissing a petition filed by Dr Savio Pereira who
works at St John’s Medical College.

The petitioner had moved the court challenging the practising of two retired professionals turned advocates before the Competition Commission of India (CCI).

The petitioner had contended that one person was an ex-chairman while another was an ex-member of the CCI and both were practising before the same forum, which is against the law.

The court stated that the petitioner had not made the persons concerned as parties in the petition.

The bench also stated that the petitioner should have approached another forum with his concerns before approaching the high court.
