Central nod must for fixing DG's tenure: CS

SC had sought Karnatakas reponse on police reforms

Appearing before the three-judge bench of Chief Justice S H Kapadia, Ranganath and state Advocate General Ashok Haranhalli said the state will have to consult the Centre and the Union Public Service Commission to make the tenure of the director-general of police a fixed one.

Haranhalli also added that Karnataka has constituted the State Security Commission with two retired judges and other members to review the security situation in the wake of recent terrorist and anti-national activities. The commission will have its first meeting on December 14.

The state has also constituted state-level and district-level police complaint authorities to help the public identify issues with the police.

In its affidavit, the state has said that it will give two years as fixed tenures for the DIGs, SPs and SHOs and give the reasons to the chief minister should they be transferred within the tenure.

The bench granted four weeks to the state government and said: “In our view it goes against the spirit of the court judgment. The state has been asked to file a reply after seeking instruction from the government.”

The apex court had asked chief secretaries of Uttar Pradesh, Maharashtra, West Bengal and Karnataka to personally appear and explain the reasons for failing to implement its September 2006 judgment on police reforms after seeing the report by Justice Thomas Committee it had set up to review the implementation.

“Why are you dragging the feet on its implementation,” the bench asked.
The bench also noted that the four states were reluctant to file the affidavits on the status of implementing the ruling.

The apex court on September 22, 2006, issued a series of directions aimed at reforming police functioning in the country on a petition filed by former Uttar Pradesh director-general of police Prakash Singh.
