State to reply on iron ore export ban in two weeks

Last Updated 16 December 2010, 19:10 IST

A bench of Justices R V  Raveendran and A K Patnaik said it would hear the petitions filed by Sesa Goa, MSPL and other mining firms in January second week.

Anitha Shinoy, who appeared for the state government, submitted that Karnataka has incurred a loss of more than Rs 6,000 crore in revenue collection due to illegal mining and export of iron ore from the State.

The authorities had seized more than eight lakh tonnes of illegal iron ore, which was set to be exported to foreign countries. Additional Solicitor General Hiranbhai Rawal said the Centre was opposing only the ban on iron ore export and the state could take steps to enhance revenue collection.

Senior advocates Soli Sorabjee and K K Venugopal, who appeared for the mining companies, submitted that the order to ban export from the state was illegal.
On November 26, the apex court had issued a notice to the state government asking it to file a response to the petition filed by MSPL Ltd, challenging the high court ruling upholding the ban on iron ore export from the State.

Independents’ plea

The Supreme Court on Thursday allowed the five disqualified Independent MLAs from Karnataka to amend the petition challenging their expulsion from the Assembly under the anti-defection law.

A bench of Justice Altamas Kabir and Cyriac Joseph dismissed the petition filed by the BJP’s chief whip D N Jeevaraju and V T Ravi who challenged  the Karnataka High Court order that allowed the Independent MLAs to make alterations in their petition.
