Katta Jagadish moves HC against FIR

KIADB and a land acquisition officer too file criminal petitions

The duo in two separate petitions sought to quash the first information reports (FIR) filed against them by Lokayukta police. Both the petitions will come up for hearing on Tuesday before the vacation bench.

The Lokayukta police had filed the FIR against Jagadish and others for their involvement in land scam and receiving compensation from KIADB for government land.

The Lokayukta police had filed the case against Katta Jagadish under section 13 (1)(c), 13 (1) (d) and 13 (2) of Prevention of Corruption Act and section 465 (forgery), 420 (cheating) of Indian Penal Code (IPC).

It was alleged that through ‘Itasca software Development Private Limited,’  Jagadish had received the compensation for one acre 16 guntas of government land at Bandikodegehalli. Lokayukta police had registered a case against Jagadish for receiving compensation for government land.

In another petition, the director of Itasca company and Muninarayanappa, former SLAO, the KIADB has challenged the six allegations made against him by the Lokayukta police.
Lokayukta had alleged that without verifying the records, the petitioner, during his tenure as SLAO, KIADB had disbursed the compensation to the person who had impersonated a land owner. Instead of awarding compensation to Mary John for acquiring her land near Bandikodigehalli, he had disbursed the same to another person, who claimed herself as Mary John, Lokayukta police said.

In another case, while awarding compensation for acquiring land for hardware park at Bandikodigehalli village, Muninarayanappa disbursed the compensation to two persons, instead of one and also compensation paid without securing indemnity bonds and sale deed, the FIR stated.

He has also disbursed compensation to Hanumakka, resident of Kavadudasenhalli on July 29, 2008. Interestingly, the person was declared dead by the Tahsildhar much before.

In another case, the petitioner had disbursed compensation to Katta Jagadish for acquiring government land. According to the FIR by Lokayukta, the petitioner’s irregularities has cost the State exchequer of Rs 42.86 crore.

Challenging the FIR, the petitioner said that the cases against the petitioners is not raised by the claimants and that the suo motu case against him by Lokayukta Police is ultra vires as the entire procedure is without jurisdiction and deserves to be quashed.

He also said that the investigating officer attached to the Lokayukta is not competent to conduct the probe.
