Forum directs BDA to allot sites

S Nagappa had applied for allotment of a 50x60 sq feet site in the year 1984. He was first allotted a 30x40 sq feet site which he had not applied for. His subsequent requests and reminders were ignored. His letter to the Authority with all the relevant documents failed to elicit any reply.

Nagappa approached the Appellate Authority in February 2008 and he was told that he would be allotted a site in Arkavathy Layout. He again furnished seven receipts but was again disappointed.

The septuagenarian approached the consumer forum where the BDA claimed that the complaint was barred by time. The Forum observed that the complainant had been renewing his request for a site time and again and hence his petition was not barred by time.

It found the BDA guilty of gross deficiency in service and directed it to allot a 50x60 sq ft site within three months of the order, along with costs of Rs 10,000.
