High Court upholds election to KOMUL reserved seat

 A division bench of the High Court has upheld the unanimous election of Gangamma for the reserved seat of Kolar Chikkaballapur Milk Producers Cooperative Societies Federation.

 Gangamma of Garudanapalya had contested for the seat from Kolar segment. Gayathramma, another contender, had questioned the decision of the returning officer in declaring the unanimous election of Gangamma.

The court had annulled the declaration and directed to conduct fresh elections. Gangamma had filed an appeal against the said order.

The High Court, while upholding the election has set aside the direction to conduct fresh election. The unanimous election of Gangamma has thus become final, in view of the court orders.

Nominations rejected

Gangamma, Gayathramma and Shobha had filed nominations for the elections. However during the scrutiny, the nominations of Shobha and Gayathramma were rejected on the ground that the cooperative societies they represented were of ‘C’ grade while rules stipulate that only those representing ‘B’ grade societies are eligible to contest.
The returning officer K S Archana, had therefore rejected the nomination of Shobha and Gayithramma and declared Gangamma as elected, unanimously.

Gayathramma had questioned the rejection of her nomination in the High Court claiming that the Cooperative Societies Auditing Department has accorded ‘B’ grade to the society she represented while Kolar Milk Union  had registered the Society  as ‘C’ grade in its records.

The court, in an interim order passed on July 2, had directed to conduct election to the reserved seat on July 3. However, the returning officer had expressed inability to conduct election as there was no time left for preparations.

 The bench, therefore, had ordered to conduct election on July 19. However, the election stands cancelled as the unanimous election of Gangamma has been upheld.
