Encroachment: HC notice to Somanna

In a public interest litigation, the petitioners, Narayanappa and Nanjappa, both residents of Pattegarpallya near Magadi Road, had challenged the encroachment and construction of a building on survey number 380 at K P Agrahara in Bangalore North taluk. According to them, the Minister had encroached upon 1.18 acres land and started constructing the building in 2008, which is almost complete now. They pointed out that  public money (the MLA fund) was being utilised to construct the illegal building.

The petitioners further said the respondents, the revenue department, BBMP and others, despite the provision to act against it had turned a blind eye. They sought the Court’s directions to stop the construction immediately and demolish the building. The division bench comprising Chief Justice P D Dinakaran and Justice V G Sabhahit has ordered notice to Somanna, the State Government, BBMP and others.
