Seller on mat for faulty mattress

Last Updated 30 January 2011, 18:52 IST

P V Prasanna had purchased the mattress for his father, a brain tumour patient. The product had a six-month warranty.

Trouble

A few days later, the water from the bed leaked out on the floor and Prasanna’s mother, who stepped on it, slipped and fell down.

The seller gave a rude reply when Prasanna complained and refused to replace the defective product. The Forum found Religare Wellness Limited and Pill and Powder guilty of deficient service.

The Forum directed both Religare and Pill and Powder to pay Rs 5,000 compensation jointly and refund Rs 2,815 towards the cost of the defective mattress, to the consumer.

Courier firm pulled up

The Second Additional Forum has directed Professional Couriers to pay Rs 5,000 as compensation to a consumer whose consignment did not reach the addressee.

Syed Murtaza was to get a document through courier from his son. The latter had booked the mail at Professional Couriers in Chennai.

However, the mail Murtaza booked never reached the given address. The courier firm failed to appear before the court.

Compensation realised

Two aggrieved consumers have got the compensation awarded by the forum, through execution petitions.

The court had ordered a firm named Hoston, to pay Rs 95,000 to H Suma, a complainant. Since the opposite party did not deposit the amount, Suma had filed an execution petition seeking deposit. The firm has deposited the award amount.

Another instance

In a similar case, Confident Project (India) Limited has deposited Rs 26,514 towards satisfaction of the award in favour of P V Prasanna and T Babu.
