BSY in court: Courts seeks certified documents

The 23rd Additional City Civil and Sessions Court Judge C B Hippargi completed recording of the sworn statement on a charge in a complaint in which Sirajin Basha, an advocate, alleged Yeddyurappa had violated rules for an unlawful gain of Rs 16 crore, causing a loss of Rs 26 crore to the exchequer.

The judge directed Basha to furnish the certified copies of the documents by next week and adjourned the case to March 16.

After Governor H R Bhardwaj's sanction for prosecution of Yeddyurappa, Basha and another lawyer K N Balaraj filed five complaints against the Chief Minister, his sons B Y Vijayendra and B Y Raghavendra, MP and son-in-law Sohan Kumar, and others for alleged nepotism and corruption in land denotification.

In his sworn statement, Basha alleged that Bangalore Development Authority had acquired over 98 acres in 1984 to form a layout on outer ring road here in various survey numbers to hand it over to a Housing Cooperative Society.

A woman Akkamma filed an application before BDA requesting them to amalgamate 18 metres of the road to site numbers 1 to 10,which BDA conceded and subsequently issued a notification. She was neither the Khata-holder nor land owner, Basha said.

After the notification, the Society in a joint venture with a real estate developer sold site numbers 6, 8 and 10 to a woman and three others who resold them to four others in 2008.

Later, these four sold site number 10 and 18 metres road to the sixth accused (in the complaints), Davalagiri Property Developers Pvt Ltd, Basha submitted.

Meanwhile, BDA made the amalgamation at the direction of another accused, Krishnaiah Shetty, the then minister in charge of BDA.

Totally, the amalgamated road measures 2.65 lakh square feet, of which 1.37 lakh square feet was supposed to be relinquished to BDA but was not done, he said, claiming all rules and regulations were violated with the common intention of pecuniary (unlawful) gain.

Earlier, counsel for complainants Anup Chowdary filed an application before the Special Judge to take up the case on a daily basis.

The Special Judge said he would pass the orders o this application on March 16.
