SC allows ED four-day custody of Hasan Ali

A Bench of Justices B Sundershan Reddy and S S Nijjar said they were “deeply disturbed” over the way Special Judge M L Tahaliyani, famous for trial of Ajmal Kasab in the 26/11 attack case, passed the order on March 11 allowing Khan a bail. “The order passed by the learned judge has created an extra-ordinary situation which may ultimately frustrate the entire investigation. Having regard to the extra-ordinary situation, complexity of the issue and the magnitude of the case, we deem it fit to stay the order,” the Bench said.

Solicitor General Gopal Subramaniam made a forceful plea for the apex court’s intervention seeking cancellation of the bail order. He termed as “extra-ordinary” the way Khan was granted bail in the money laundering case by the court without any request by the accused. “The accused has not even filed a bail application. The judge went on to conclude that the documents produced by the ED were not reliable,” Subramaniam, appearing for the ED submitted.

He said the special judge did not take into consideration even the plea that bank accounts numbers, which are very confidential, should not be revealed in the order. The counsel also alleged that Khan had cleaned up $60,000 from his three Swiss bank accounts since 2001. Khan was arrested  on March 7 under the Prevention of Money Laundering Act.
