SC dismisses miner's plea

Last Updated 11 April 2011, 18:54 IST

A Bench of Justices Dalveer Bhandari and Deepak Verma found no merit in the pleas filed by B R Surendranath Singh against the decisions, and also decided to impose a cost on him.
“The theory of somebody had put one lakh-tonne of iron ore is totally untenable and beyond comprehension. One lakh-tonne of iron ore cannot be kept on any mining lease all of a sudden without the knowledge of the appellant,” the Bench said.

“Thousands of trucks have to transport the said quantity of iron ore and if it did not belong to the appellant he ought to have complained immediately after someone started dumping iron ore on his mining lease,” the Court added.

It noted that the Department of Mines and Geology, Karnataka had said that it was a clear case of illegal mining on a massive scale.
