Med college ordered to admit student

Petitioner Hanock Nishchal had been allotted a seat under the three reserved seats for Christian minorities at the college in the MS exams in General Surgery. He was eligible for the second seat. During counselling, his seat was confirmed. He had submitted his original documents and paid Rs 4.56 lakh to ComedK to be forwarded to the college.

When Nishchal tried to get admitted, he was told that his seat had been filled up. The college added that admissions were given on a first come first serve basis, though he was eligible for the seat as per the confirmatory letter by ComedK. The college argued there was confusion and he could not be admitted. Nishchal asserted in his petition that the college did not even return his money.

A division bench comprising Justice K Bhaktavatsala and Justice B Manohar directed the college to admit the petitioner immediately pending consideration of the writ petition.
