KMC exonerates Fortis Hospital

KMC passed the order after examining the affidavits of both the complainant and the respondents and cross examination of the parties and witness. The Council concluded that Rai had signed the ‘informed consent’ for a high risk procedure which was witnessed by her daughter. The doctors at the hospital had performed kidney and pancreas transplant in the interest of the patient and not for personal gain, the Council ruled.

Although KMC unanimously opined that there was ‘no negligence or violation of code of medical ethics,’ Fortis Hospital was given a ‘warning’ to follow the instructions of appropriate authority for transplantation, according to Transplantation of Human Organ Act 1994, and take measures to control infections and submit a compliance report within 20 days.
