Pointing out that 1,069 acres has been acquired for a project that requires only 35 acres, the Court wanted to know for whom the land had ben acquired.

The Court refused to buy the Government’s argument that the land had been acquired to meet the future demand. It warned the Government that the Court had the power to set aside the acquisition notification.

“The plan is yet to take off and you have already acquired land for future. You have been acquiring land at gun point without concern for landlosers,” Justice D V Shylendra Kumar said.

Petitioner Matekarunnisa had approached the Court contending that the KIADB had acquired the land for private purpose.
