HC imposes Rs 1 lakh fine on govt

The Bangalore Development Authority had cancelled the allotment of site to K Vijaykumar on the grounds that the land was denotified. It offered an alternative site and collected the registration charges for the site.

However, Vijaykumar changed his mind and sought reimbursement of the registration fee collected for the alternate site. When the government refused to reimburse him, he approached the court seeking relief. A single judge allowed the petition and ordered the State to return the fee.

The State government immediately approached a Division Bench appealing against the single judge order.

A Division Bench comprising Chief Justice J S Khehar and Justice Ashok B Hinchigeri dismissed the appeal and imposed a cost of Rs one lakh on the government. The State has also been directed to reimburse the registration fee.
