SC refuses plea to monitor CBI probe into CWG scams

While refusing to entertain a PIL pleading the court to monitor the probe into the scam, a bench of justices R M Lodha and Gyan Sudha Misra, however, allowed the petitioner to approach it in case of any deficiency and discrepancies in the ongoing enquiry.
"Since CBI is investigating, we do not want to interfere," the bench said.

The petitioner, Delhi Study Group, an NGO, had submitted that the CBI is conducting probe against selective persons and not investigating the role of high profile politicians and government officials including the Delhi Chief Minister for their alleged involvement in the scam.

"The CBI is investigating very selectively and not touching big politicians or major beneficiary companies. For instance, the Chief Minister of Delhi had a direct and active role in the decision making process of upgrading street lighting of the city which led to avoidable extra expenditure of Rs 31.07 crore," the petiton said.

Referring to the Shungulu Committee and CAG reports, it further said they have also indicated involvement of government officials who had connived with private companies for personal gains.

"The reports have indicated that the Delhi Government, other Ministries and other officers of major government organisation are prima facie involved in abusing their positions as public servants and conniving to obtain benefits for themselves," the petition said.
Sheila Dikshit has refuted all the allegations levelled aginst her and Delhi government officials in connection with the scam in the past.

"Unfortunately crores of rupees spent on organizing the games went into the pockets of few persons and they misappropriated the public fund," the petition said.

The CBI has already registered case in the scam and has arrested various officials of the Organising Committee of CWG including its chairman Suresh Kalmadi, former Director General V K Verma, former secretary general Lait Bhanot, Director General (procurement) Surjit, Lal, Joint Director General (sports) A S V Prasad and Treasurer M Jayachandran.
They are all in jail under judicial custody.

Promoters of two private companies-- Purushottam Dev Arya and A K Madan of Faridabad-based Gem International and  A K Reddy of Hyderabad-based AKR Constructions-- have also been arrested and in jail.

All the accused in the case, however, pleaded innocence and refuted all the charges levelled against them by the CBI.
