Case transferred to sessions court

A metropolian court at Andheri took the chargesheet on record and extended the judicial remand of the accused up to August 27. The magistrate also transferred Shiney’s case to a sessions court due to lack of jurisdiction in trying offences carrying sentences above three years of jail term.

Shiney was arrested by the police on June 15 after his maid lodged a complaint of rape against her on the previous day. It was a Sunday and the actor and the maid were alone in his apartment at Oshiwara in Andheri suburb, when he allegedly raped her.

The chargesheet says that on June 14, Shiney had called the complainant to his room asking for water. He then locked the room and allegedly raped her. While the police claimed that Shiney “confessed” to his alleged crime, his wife refuted the claim and asserted that her husband was “innocent.”

Case on fast-track
Maharashtra Chief Minister Ashok Chavan and the National Women’s Commission chairperson Girija Vyas too stepped in and it has been decided to fast-track the trial. However, an official notification has not been issued so far, and as per the Andheri’s court’s decision, the case has gone to the sessions court.

After his arrest, Shiney had moved the sessions court for bail but it was rejected on the ground that there existed prima facie evidence against him.

The chargesheet contains medical and forensic reports of the actor and the victim, statements of the witnesses, including the neighbours and those who helped the complainant girl to lodge the complaint.

Medical reports indicated sexual intercourse between the actor and the maid after forensic experts retrieved semen stains from the maid’s private parts and they matched those with the actor’s DNA profile.

The complainant’s statement has already been recorded before a magistrate under the provisions of section 164 of the Criminal Procedure Code (CrPC) to strengthen the case.

Shiney continues to be in judicial custody and is spending his time behind bars at the high security Arthur Road central prison in South Central Mumbai.
It is now for the sessions court to frame charges against the actor and conduct the trial speedily.
