HC orders contempt notice to Palike

Five Year Law Course Advoates’ Association had moved a petition stating that the BBMP authorities have failed to implement the High Court order dated August 4, 2011 directing the civic agency to remove illegal structures over stormwater drains in the City in a month.

Counsel for the petitioners, S Umesh in his submission pointed out that the respondents in their affidavit dated August 3, 2011 stated that the encroachments would be cleared according to the court direction and the information would be furnished to the petitioner on a monthly basis.

“However major encroachments on JC Road, Lalbagh, Shivajinagar have not been cleared and even the information provided by the petitioners as directed by the court regarding the encroachments of SWD by Baptist Hospital, Mallya Hospital,  Garuda Mall and Raja Prakrithi hospital have not been considered,” he said.

Sale nullified

The High Court has declared null and void, the sale of 6,000 square feet of land belonging to Kadu Malleswara in favour of Sai Mandali.

The Division Bench comprising Chief Justice Vikramjit Sen and A S Bopanna held on Thursday that order of the government allowing the sale violated the Hindu Religious and Charitable Endowment Act and set aside the sale.

The Division Bench noted that the temple is an ancient structure and the government should take steps to preserve the temple.
