1,400 students await admission

DoE fails to obey high courts order to admit the students, alleges NGO

In spite of a recent High Court order to the Directorate of Education, to start the process of admission of 1,400 students to Class VI of its 17 Rajkiya Pratibha Vikas Vidyalayas for the academic year 2011-12, the students are still waiting to be admitted.

Social Jurist, an NGO, has sent legal contempt notice to DoE on Tuesday regarding non-implementation of division bench order dated December 14, 2011.
“It has been a month since the HC has given the order to admit these 1,400 students. The admission process for the academic year 2011-12 started in April 2011, it is already January 2012.

“The session is about to end. When I spoke to Diwan Chand, director of Education, he had told that in a week's time the court’s order will be implemented. But it's a month now and the situation is still the same,” said advocate Khagesh Jha, member of the organisation.

The complaint filed by the organisation states, “A division bench of Hon'ble Delhi High Court passed an order about admission of 1,400 students in Rajkiya Pratibha Vikas Vidyalayas but you (Directorate of Education) under malafide intention deliberately avoided the compliance of the above said order. This act of yours tantamounts to contempt of order passed by division bench of Delhi High Court and there is provision of penal action against you for this contempt of order passed by Hon'ble HC.”

In 2010, RPVV, schools run by the DoE, started a screening procedure for admission in elementary classes. The organisation filed a case in HC against the screening process. In October 2011, the government agreed to call off the admission process. The government pledged before the HC that admission from the next academic session, in its special category schools and RPVVs, shall be done keeping in view the provisions of the welfare legislation — which prohibits any kind of “screening procedure for admission” up to Class VIII.

“Then a case for not admitting students in class VI was filed in the HC. The DoE told that due to unclear criterion they could not admit these 1,400 students. The HC ordered on December 14, 2011 to give admissions to the students,” said Jha.

Admission of students to Class VI in 17 out of 19 RPVVs did not take place in 2011.
