10 years after mishap, Rs 33.7 lakh relief

In a landmark judgment, the Karnataka High Court on Friday awarded the compensation to Rao.

Rao was 45 in 1999 when he was involved in the accident. He lost not just his job as managing director of Vishnu Forge Industry but also his memory. He approached the Motor Accidents Claims Tribunal for compensation and was awarded Rs 8.53 lakh.

He later approached the High Court asking seeking more compensation. Admitting his plea, the court has directed the insurance company to pay Rs 33.70 lakh compensation, a three-time increase over the amount awarded by the Tribunal. In addition, a 6 per cent interest on that amount from the day the application was filed, will also have to be paid to him. The Division Bench comprising  Justice K L Manjunath and Justice B V Nagarathna also directed the insurance company to pay Rs 10 lakh out of the Rs 33.70 lakh to his wife.

The court said  that the children’s education and marriage should be undertaken with this amount.

The rest of the amount would be paid to Raghavendra Rao in the form of security deposits in a nationalised bank and the interest on this amount would be paid to the family on a monthly basis.
