Swamy surprised, to appeal in higher court

Janata Party chief Subramanian Swamy on Saturday expressed his surprise over a Delhi court dismissing his plea to make Home Minister P Chidambaram a co-accused in the 2G spectrum allocation case, but said he will file an appeal against the order in the higher court.

“I am surprised but not disappointed because this is part of the game. I will go to another court. This order deserves to be reserved. I will certainly appeal against it,” he said, soon after the special CBI court dismissed his petition against Chidambaram.

The Janata Party chief insisted that he had a “very strong” case both against Chidambaram and former telecom minister A Raja, the prime accused in the scam who is behind the bars in this connection.

“I will appeal in the High Court and, if need be, I will go to the Supreme Court,” he said and vowed to continue his “battle against corruption”.

Swamy said that he would think whether he should file an appeal against the trial court’s order in the Supreme Court, pointing out that in a matter earlier, the apex court had said that a trial court's decision could be challenged directly before it.

“This is nothing new for me. I will go for an appeal (in higher court). This is not the first time that a petition has been dismissed," he said, expressing his confidence in the judiciary.

He recalled how his appeals against High Court decisions in the cases of grant of sanctions and cancellation of 2G licenses were upheld by the Supreme Court.

Swamy refused to accept that Chidambaram was vindicated by the Special CBI Court’s order on his petition. “How can Chidambaram be vindicated by one court unless he is vindicated in all the courts?” he added.
