SC stays arrest of 13/7 blast accused

The Supreme Court on Tuesday stayed the arrest of Taquee Ahmed, whose brother has been arrested in connection to the 13/7 Mumbai blast.

Responding to Taquee’s plea alleging false implication and threat to life, a bench of justices Altamas Kabir and J Chelameswar put the stay on Ahmed’s arrest till February 21 and issued a notice to the Ministry of Home Affairs, the Delhi police and the Mumbai Anti-Terrorism Squad (ATS).

Advocate Sanjay Khanna, appearing on behalf of Taquee, referred to media reports on Mumbai ATS sleuths trying to nab Taquee from Zakir Nagar here on Monday, without taking the Delhi police into confidence.

According to the petition, the brothers were informers and had helped Delhi police’s special cell in cracking the 13/7 case. Taquee runs a luggage shop here after completing his BBA. On January 9, the special cell had taken Naquee to Mumbai. He was arrested a day later along with a co-worker of his brother’s bag manufacturing factory in Mumbai.
The Mumbai ATS kept vigil on his family members and allegedly threatened Taquee, who subsequently complained to Delhi police and the National Human Rights Commission on January 23. However, according to the petition, the Mumbai police named him as a “facilitator” in the case.

The Delhi police had interrogated the brothers and let them off, the petition said. It also raised questions on how a person declared innocent by one agency can be arrested as a key accused by another and sought transfer of the case to the CBI.
