The Special Lokayukta Court on Friday rejected the ‘B’ report filed by the Lokayukta police in a case involving minister V Somanna and former chief minister B S Yeddyurappa and issued summons to all the accused in the case.

While taking cognisance of the case against Somanna relating to illegal denotification of 22 guntas in Nagadevanahalli, Kengeri hobli, judge N K Sudhindra Rao observed that the Court would decide on the conclusions drawn by the investigating officer and not the opinion of the Additional Director General of Police.

The ‘B’ report submitted to the Court had a memo filed by H N Sathyanarayana Rao, ADGP, stating that there were no evidences to substantiate the allegations made in the private complaint and directing Prasanna V Raju, the investigating officer, to file a ‘B’ report.

Summons issued

The Court ordered summons to Somanna, B S Yeddyurappa and other accused in the case, including Somanna’s wife, Shylaja.
The matter has been adjourned to April 30. Somanna and Yeddyurappa have obtained anticipatory bail from the High Court on January 17.

According to the complaint filed by Ravi Krishna Reddy, survey nos 77 and 78, measuring around three acres and registered in the name of Deve Gowda, the father of one of the accused Lingaiah, were acquired by the Bangalore Development Authority for the formation of Jnanabharathi Layout, and the final notification was published in January 1994.

In 2004, Lingaiah executed a sale deed for his share of property in survey number 78 in favour of Shylaja, wife of Somanna. Lingaiah also executed a rectification deed in favour of Shylaja to allow for construction, falsely stating that 22 guntas had been denotified.

In 2009, Lingaiah’s application for denotification was cleared by Yeddyurappa, despite strong reservations expressed by the Principal Secretary to the Urban Development Department, the complaint noted.
