DKS mum on Lokayukta court query

He owns 23 pc of land on which an apartment complex is coming up

Congress leader D K Shivakumar has chosen to remain silent on a question posed by the Special Lokayukta Court in a case pertaining to alleged conversion and illegal denotification of 4.2 acres of land in Benniganahalli.

On Wednesday, Judge N K Sudhindra Rao sought to know if he would continue construction activities in association with the builders and whether he intended to alienate or sell his share of the developer’s property.

Krishnamurthy, the counsel for D K Shivakumar, submitted that they were not willing to answer the question. “Both the developer and the petitioner are accused in the case. If he says that he (Shivakumar) has no intention of going ahead with the construction and then goes ahead, it can be used against him,” Krishnamurthy argued.

An irate Court remarked that it was entitled to ask questions and did not indicate that any answer would be used against Shivakumar, who has approached the court seeking anticipatory bail.

Krishnamurthy later filed a memo stating that Shivakumar would be exercising his right to silence guaranteed under Article 20(3) of the Constitution. The matter has been posted to July 30 for orders.

The Special Lokayukta Court has already issued summons to Shivakumar and Girish Purvankara of Purvankara Builders, with whom he had entered into an agreement for the construction of an apartment complex. Shivakumar owns 23 per cent of the land.

He had applied for anticipatory bail in the High Court, but the Court had directed him to approach the Lokayukta court within four days to file a fresh application for anticipatory bail.
