PIL on Lokayukta deferred by 2 weeks

 The High Court of Karnataka on Friday adjourned the hearing on a public interest litigation (PIL) seeking appointment of Lokayukta, by two more weeks.

The postponement came in the wake of a memo filed by the State government saying that the Supreme Court will take up a related special leave petition next week.

“The appointment of the Lokayukta is not possible till the apex court gives a verdict on according prominence to the Chief Justice of the High Court in appointing Lokayukta and Upa Lokayukta,” Advocate General S Vijay Shankar told the Division Bench headed by Justice K Sreedhar Rao.

The AG said the matter had been heard on three occasions and would come up before the apex court again in September first week.

He submitted that the State government will start the appointment process once the Supreme Court disposes of the matter.

Admission allowed

The High Court has allowed a petition filed by 48 students studying in various polytechnic colleges seeking admission to the fifth semester.

Sandeep Gowda and others had moved the court challenging the carry-over guidelines which restrict admission to fifth semester to students who have eight or less subjects pending.  

Justice Ram Mohan Reddy passed an interim order to admit the students with a penal fee of Rs 1,000 as the students were attending the college from the beginning of the semester. The counsel for the State government said that the 16-week semester had commenced on July 9 and one of the three internal assessment exams was over.

Even if permitted, the students will not be able to satisfy the 75 per cent attendance rule under regular circumstances with 15 per cent cut-off available under special circumstances. Justice Reddy adjourned the petition for further hearing.
