Tripple murder accused, court in a fix over mercy petition

A local court here received an application purportedly written by a triple murder accused pleading for euthanasia or mercy killing on the ground that he had been suffering from cancer, but the undertrial has disowned the plea.

Additional sessions judge Rakesh Tiwari received the photocopy of an unsigned application, purportedly written by accused Surender alias Kalwa, through post seeking permission for his mercy killing.

“An application was received by way of post on September 19 from accused Surender alias Kalwa with regard to euthanasia but the same has not been signed and is a photostat copy (of his application) addressed to this Court,” the court noted.

When Kalwa was brought to the court and was asked about the application, he disowned it and the court dismissed it.

“Since the application is not signed by the accused Kalwa and he disowns the same and even otherwise as per guidelines laid down by the Apex Court, such applications are not maintainable nor the same can be allowed in the circumstances of the present case,” the court said.

Kalwa is facing trial in the court of ASJ Tiwari for his alleged role in a robbery-cum-triple murder case of 2004, when he had allegedly murdered a woman, her son and her grandson, with an intention to rob them.

Kalwa had earlier been diagnosed with cancer and had been undergoing treatment at AIIMS.

The court had directed the jail authorities to provide him proper treatment and medication.

The doctor from Tihar Jail told the court that Kalwa is not critically ill and is receiving proper treatment and his condition is stable.
