Babus to face criminal case for building violations

Town Planning Dept assigned the job of sanctioning building plans

While the building owners may face penalty and demolition of the structures that are violating the bye-laws, the town planning officer may face criminal cases if they turn a blind eye to the violations.

Introducing a change in the functioning of the engineering department of the Bruhat Bengaluru Mahanagara Palike (BBMP), Palike Commissioner Bharat Lal Meena assigned the job of sanctioning building plans and checking violations to the BBMP Town Planning Department.

Earlier, the Town Planning Department had the job of sanctioning building plan while the ward engineers of the BBMP were the only authority to check building bye-law violations.
From now on, the Assistant Engineers (AE) of the Town and Country Planning will have to be on their toes to roam around his or her area and check any construction coming up illegally.

If the Assistant Engineer finds any illegal construction, he will be empowered to stop the work.

Notice to builders
He will have to report the matter to the Joint Director of Town Planning. Further, the Town Planning Officer will bring the matter to the Additional Joint Director and the Joint Commissioner, who can issue Provisional Order and Cancellation Order. A notice can also be served on the builder for violating the building plan.

A report will be finally given to the BBMP Commissioner, Special Commissioner and the Engineer-in-chief in this regard.
Criminal proceedings may be initiated against Assistant Engineers and their higher-ups if they do not act against illegal structures coming up in their respective areas.
