SHRC can't order CBI inquiry: HC

The SHRC had recommended the State to hand over the matter related to the torture of a person Suresh M R, a resident of Amruthhalli, who was taken into custody following a compliant against him by Vasanthi on July 26, 2009.

The SHRC, which registered a complaint, had ordered notice to Sub Inspector Kempegowda, Inspector M S Ashok, ACP Chandrashekar, ACP Ramachandra and DCP Basavraj Malgatti on August 20, 2009. The commission on August 22 recommended the State to entrust the matter to the CBI.

It also recommended suspension of three officers including sub-inspector and Inspector and disciplinary action against the remaining two including the DCP.
The division bench comprising Justice Billappa and Justice Arali Nagraj, upon hearing the matter, has stayed the recommendation for three weeks stating that the commission has no powers to order an inquiry.
