Court gives life term to sodomy victim for murder of 'offender'

A youth has been sentenced to life imprisonment by a Delhi court for strangulating a man, who allegedly used to sodomise him, to death here in 2010.

Additional sessions Judge Vinay Kumar Khanna also imposed a fine of Rs 5,000 on the 23-year-old convict while convicting him, relying on the fact that he was last seen with the victim on the day of the murder.

The victim worked as a security guard in a factory here. The court noted the accused during his medical examination by a doctor during the probe of the case had told him that the victim used to sodomise him.

“The motive of commission of crime i.e. the commission of sodomy by the deceased upon the accused is indicated from the history given by the accused himself to PW-22 doctor, who conducted medical examination of the accused and opined that sodomy could not be ruled out. Disclosure statement of the accused too cannot be said to be manipulated,” the court said while convicting the accused who was also working as a guard in the factory.

According to the police, it received a call on February 16, 2010 that a security guard had run away after committing theft at a factory in Okhla industrial area here and when they reached the spot, they came to know that a person was lying in unconscious condition inside the factory.

After the police entered the factory, they found the dead body of one of the security guards working there.

Police said on a tip-off, they apprehended the accused who got recovered one hand bag containing the photographs of the deceased and various other incriminating objects.

The accused said he was falsely implicated in the case and also denied that the victim did anything wrong with him.
