HC notice to govt over plea on document sheets

The High Court on Tuesday ordered emergent notice to the Karnataka State Registration and Stamps Department (KSRSD) and others in connection with a Government order dated May 9, 2003, for not considering the representation of the Advocates Co-operative Society Limited’s (ACSL) to print, sell and distribute document sheets of Rs 2.

Hearing a petition by N P Amrutesh - City-based advocate and director, ACSL - Justice Abdul Nazeer also ordered emergent notice to the State government, Revenue Department, Inspector General, Registration and Commissioner of Stamps and the Director, Director-Printing, Stationery, Publishing of the Government Printing Press.

The petition states that despite repeated representations seeking licence to trade in document sheets, the State government had refused to accord permission, but the same was granted to KSRSD and others. Contending that the Society had valid experience in dealing with document papers, the petitioner stated that the State government was giving lame excuses to grant licence.

Allegation

Alleging that during the meeting, held on February 18, 2010, the Secretary, KSRSD tried his best to convince the petitioner, offering to supply document sheets worth less than Rs 1.50, the petitioner submitted that the attitude reflected the respondent’s monopolistic attitude.

Submitting that the State could not create a monopoly by granting permission only to KSRSD, the petitioner said that it was against the fundamental principles of equality enshrined in the Constitution and sought a direction to consider the representation of the petitioner Society and permit them to print, distribute and sell document sheets.
