Judges say courts should take overall lead to maintain balance in society

The Supreme Court has said as crimes against women have a deeper social impact, the punishment awarded to the convicts should not only be exemplary but also reflect public abhorrence of their acts.

A bench of Justices P Sathasivam and M Y Iqbal said the courts should take an overall view and strike a balance between severity of the crime and its effect on society and the victim while sentencing the guilty.

Social impact

“In justice delivery system, courts are conscious and mindful of the proportion between the rigor of offence committed and the penalty imposed as also its impact on society in general and the victim of the crime in particular.

“Social impact of the crime where it relates to offences against women cannot be lost sight of and per se requires exemplary treatment. Public abhorrence of the crime needs reflection through imposition of appropriate sentence by the court,” the court said.

The apex court gave the ruling while dealing with an appeal filed by a man challenging life imprisonment imposed by a trial court at Salem and upheld by the Madras High Court for murdering his sister-in-law and her 13-month-old baby girl after raping the former.

Upholding the sentence for the “gruesome act of rape followed by double murder,” the court directed the authorities not to grant the convict, Kumar, remission without strictly complying with the principles laid down in various verdicts.

Extra-judicial statement

The convict was nailed as the court relied upon the extra-judicial statement made by him before a neighbour, who recounted how he came to her house and demanded kerosene on the fateful day of August 15, 2003.

Kumar, according to the witness, forced her to call the family of the deceased to tell them that she (deceased) was going to commit suicide. The witness, who was threatened against revealing the incident to anyone, told the police everything during investigation.
