On a media report that Dinakaran’s name had been dropped from the list of five judges forwarded to the government, Justice Balakrishnan said: “No, no. We have not taken any decision as yet.’’

Speaking to reporters on the sidelines of the all-India conference of the Central Administrative Tribunal (CAT), Justice Balakrishnan  said: “We have only asked that the names of four other judges should be processed for their appointment as judges of the Supreme Court.”

A meeting of the Supreme Court collegium on October 25 decided to delink Dinakaran’s name from the list. Also, a formal letter in this regard was sent to the government by Justice Balakrishnan last week.

The collegium had recommended the names of Justice Dinakaran, Chief Justice of the Madhya Pradesh High Court A K Patnaik, Chief Justice of the Punjab and Haryana High Court T S Thakur, Chief Justice of the Calcutta High Court S S Nijjar and Chief Justice of the Gujarat High Court K S Radhakrishnan for elevation to the apex court.

Sources said the SC had sought more information from the Tamil Nadu government in view of a representation from some advocates from Tamil Nadu and Forum for Judicial Accountability to Justice Balakrishnan for a probe by the Central Bureau of Investigation  into the land-grabbing scandal.
