HC notice to KPSC over faulty deduction of marks

The High Court on Monday ordered emergent notices to the State government and the Karnataka Public Service Commission in connection with the faulty deduction of marks of a candidate, during the process of scaling and moderation of marks.

A candidate, K Muralidhar, has moved the High Court seeking to set aside the process of scaling and moderation initiated by the KPSC. The petitioner, a 1998 batch candidate, was selected as Deputy Superintendent of Excise, but his selection was challenged after some of the candidates moved the Karnataka Apellate Tribunal (KAT) citing irregularities in the main examination.

After the KAT ordered a revaluation, the petitioner moved the High Court which ordered to conduct a moderation. However, the KPSC in its effort of moderation, deducted 201 marks from the petitioner and reduced his ranking. He was selected to the last post of Assistant Chief Auditor.

When several representations to set it right did not yield results, the petitioner moved the High Court again.

Stating that the faulty moderation by KPSC has pushed him down in the ranking, he contended that KPSC violated the directions given by this court in not conducting the moderation in the prescribed way.  Mentioning that the moderation process was to be conducted by head examiner and chief examiner as per the High Court directions, the petitioner said the KPSC violated the directions given by the court in not conducting the moderation in a prescribed manner.

He contended that the Court had stated that the entire process of moderation shall be under the supervision of secretary of KPSC and that it is open to him to have the moderation done at a two-tier level (that is head examiner and chief examiner). But the second respondent violated the directions and conducted the moderation in an improper manner and the same has caused prejudice to the interest of the petitioner.  Justice A S Bopanna, who heard the matter, has ordered emergent notice to the State and the KPSC.
