Dealing with an accident compensation case involving an Indian Air Force (IAF) vehicle, Justice J R Midha said: “It is a matter of concern that such frivolous and unjust litigation by the government and statutory bodies is on the increase. They should be a responsible litigant.”
The court dismissed the IAF appeal against the Motor Vehicle Tribunal’s order to grant compensation to the kin of a man hit by an IAF truck which made him immobile and eventually caused his death.
Justice Midha observed that the government and Indian Air Force authorities should not raise frivolous and unjust objections or act in a high-handed manner. They should not behave like private litigants with merely their profits in mind, he said while dismissing the case that challenged the tribunal’s order.
